The L1 Visa is a document that facilitates a professional’s non-permanent transfer to the United States. He or she should fall into one of three categories: executive, managerial, or specialist expertise. Under the following conditions, a person seeking an L1 Visa may be approved for a transfer to the United States:

  • The applicant is joining the same organization or its parent or subsidiary in the US as he or she was working for in their native country.
  • The applicant is joining the headquarters of the company he or she is currently working for.

The L1 Visa has the advantage of allowing a company to transfer a significant number of employees to the United States through blanket approval. The L1 blanket approval eliminates the need for each employee to obtain individual approval from the United States Citizenship and Immigration Services (USCIS) for a move. A company is eligible for an L1 blanket approval if the following conditions are met:

  • The organization is originally based in the US and has over a 1000 employees.
  • The organization has previously received approval for at least 10 of its employees for an L1 Visa in the past 12 months.
  • The organization and its subsidiaries must have annual sales of at least $25 million

  • Mention the name of some of the clients that your company has acquired in recent years.

What is your monthly/yearly salary?

  • Mention the monthly/yearly compensation provided by your current organization.

How many people currently are under your supervision in the company?

  • Mention the number along with the details of the people who are currently under your supervision in the company.

Why is the sponsor mentioned in the petition letter different to your current organization?

  • If the sponsor you identify in the petition letter is not the same as your existing organization, provide the immigration officer logical and honest explanations why.

Why have you not changed your organization even after working for more than 10 years here?

  • Any specific reason?If you’ve worked for your current employer for more than 10 years, tell the immigration officer why. Proving the company’s legitimacy to the immigration officer will help you be approved.

Have you gone through any training when you joined your current organization?

What is the exact location of the company you will be transferred to in the United States?

  • Answer this question with the appropriate details mentioning the town/city/state of the office to which you are being transferred.

What is the nature of work that you will do on behalf of your company in the United States?

  • The immigration officer wants to know everything about the work you’ll be doing for your company in the United States. You must explain your job responsibilities and functions to the immigration officer.

What will be your compensation in the United States and will you receive it in dollars or any other currency?

  • Answer the question with specifics. If your employer will pay you in a foreign currency rather than dollars, you must inform the immigration officer.

Why can’t the work be performed from the country where you presently live?

  • The immigration official wants to know why you need to come to the United States to complete the work rather than staying in the country where you now live and working from there. To persuade the immigration official, provide solid reasons for your need to transfer.

Will your direct supervisor be also residing in the United States?

  • Answer the question accordingly.

  • Answer the question with appropriate details. Mention the extent of your authority in the company to the immigration officer.

What unique skill sets do you possess?

  • Mention the unique skill sets you possess to the immigration officer.

How many years of experience you have in this line of profession?

  • Mention the answer with appropriate details.

Why cannot the citizens of United States who are working in the same organization do the work that you are supposed to do when you are transferred to the United States?

  • This is a significant question that requires careful consideration. Mention the logical reasons why the locals cannot accomplish the work that you are expected to undertake after being transferred to the United States.
